An Etsy seller outside EU: EORI, VAT and product safety for Europe must organise compliance around the actual route of each product: direct dispatch from a non-EU country or stock imported into the Union. EORI supports customs formalities, VAT depends on the import and sales arrangement, and GPSR requires product safety, traceability and online information.
Key takeaways
- Handmade, personalised and small-batch products are not automatically exempt from EU customs, VAT or product-safety rules.
- An EORI number identifies an operator for customs procedures; it does not replace a VAT number or VAT registration.
- Regulation (EU) 2023/988, the General Product Safety Regulation (GPSR), has applied since 13 December 2024 and sets specific requirements for consumer products offered online in the EU.
- A non-EU manufacturer must check whether an EU-established responsible economic operator is required under GPSR or applicable sector-specific legislation.
- Your Etsy listing must show the applicable safety and traceability information before the consumer places an order.
Who is affected when selling on Etsy from outside the EU?
You are affected when you offer physical products to consumers in the European Union, even if you are a small craft business, sell occasionally, or make personalised orders. The applicable rules depend on the product, where it is made and stored, and the route it takes to the buyer.
If you make jewellery, candles, textile accessories, decorative goods or stationery and sell them under your own name or brand, you will usually be the manufacturer for product-law purposes. The same can apply where a workshop makes the item for you and you market it under your own brand.
The importer is generally the operator established in the EU that places a product from a non-EU country on the EU market. A distributor makes a product available without being its manufacturer or importer. These roles do not follow from the Etsy shop name alone: they must be assessed against the real supply chain and customs documents.
Example: you make leather pouches in Morocco and send them individually to customers in France, Germany and Italy. You remain the manufacturer. However, the person named in the import declaration, the VAT treatment and the economic operator identified for product safety may differ according to the arrangement you use.
Before publishing dozens of product references, use the EU Market Entry Compliance Assessment to map your products, storage countries and destinations. It helps you identify checks to make; it does not replace legal analysis or a decision by the competent authority.
When does an Etsy seller need an EORI number?
An Etsy seller will generally need an EORI number when acting as an operator in a customs declaration to import stock into the EU or complete other customs formalities. EORI is a customs identifier, separate from VAT and from your Etsy shop details.
The European Commission describes EORI as the Economic Operators Registration and Identification number used in dealings with EU customs authorities under the Union Customs Code, Regulation (EU) No 952/2013. Practical information is available from the European Commission’s EORI guidance.
Direct dispatch to the buyer or imported stock
If you send a parcel from Shenzhen, New York or Casablanca directly to an EU consumer, establish who is declared as importer and who handles the formalities. A customer does not automatically become a professional importer simply because they receive the parcel. The delivery terms, transport documents and customs declaration matter.
If, instead, you send a pallet to a warehouse in Germany or France, or to a fulfilment provider, you are arranging an import of stock. In that scenario, the EORI of the relevant operator is usually central to customs clearance. Read the guide to importing stock into the EU to distinguish the steps before goods arrive.
A common mistake is to apply for EORI believing it alone authorises sales across every EU country. It supports customs identification; it does not deal with VAT, product compliance or any environmental obligations that may apply.
Where you need to assemble an application, EORI file preparation helps prepare the submission. It is a one-off service unless included in a SaaS plan quota; the number itself is issued by the customs authority, which remains responsible for registration.
EU Seller Kit — For a first stock shipment into the EU, begin with the EU Market Entry Compliance Assessment, then use EORI file preparation if your role in the import requires an EORI number.
What VAT applies to Etsy sales into the European Union?
VAT depends on where the goods are when sold, the value and nature of the consignment, the arrival country and the scheme used. Etsy may collect VAT in certain marketplace scenarios, but that does not remove the need to check your own obligations.
Council Directive 2006/112/EC on the common system of VAT provides the EU VAT framework. For distance sales and reporting schemes, the European Commission explains the VAT One Stop Shop, including OSS and IOSS.
IOSS, import VAT and EU-held stock
IOSS, the Import One Stop Shop, may be relevant to certain distance sales of imported goods in low-value consignments. Subject to its conditions, it allows VAT to be collected at the point of sale and declared through a single portal. It does not automatically apply to every product, seller or delivery route.
When you import stock into the EU before selling it, import VAT and the VAT obligations arising from storage, domestic sales and cross-border sales must be assessed separately. Imagine a US manufacturer sending 500 notebooks to a French warehouse: importing the batch and later selling to German customers are not one single VAT transaction.
Use the EU VAT calculator to compare common domestic, intra-EU and import VAT scenarios using your actual transaction flow. Then confirm the chosen treatment with the relevant tax authority or a tax adviser, particularly if you hold stock in more than one Member State.
What GPSR rules apply to Etsy creations?
GPSR applies to consumer products placed on the market or made available in the EU, except where sector-specific legislation provides safety rules covering the relevant risks. A handmade or one-off creation is not exempt merely because it is unique or made by hand.
Regulation (EU) 2023/988 on general product safety, known as GPSR, has applied since 13 December 2024. It requires products to be safe and sets obligations for economic operators, including in distance sales.
Identify the responsible economic operator in the EU
For products covered by GPSR, where the manufacturer is not established in the EU, you must check that an EU-established economic operator can perform the functions required under the Regulation. Depending on the circumstances, this may be an EU manufacturer, importer, authorised representative or responsible person appointed for this framework.
This does not mean that a software subscription automatically appoints a responsible person. The GPSR Responsible Person (EU) service becomes active only after product review, entity assignment, a signed mandate and active payment. Check that its scope matches your products and trade flows before placing products on the market.
The role is not a product “approval” without supporting records. The operator must, among other things, be able to cooperate with authorities and provide the information or documents requested under the applicable framework. Market-surveillance authorities have powers under Regulation (EU) 2019/1020 on market surveillance and compliance of products.
Show the right information on the Etsy listing
Online sales must provide the consumer with the applicable information before purchase. For products covered by GPSR, this can include product identification, manufacturer contact details, the contact details of the responsible economic operator in the EU where required, and relevant warnings and safety information.
A photograph of a label is not always enough if it is unreadable, incomplete or missing from some variants. Information must suit the product and be understandable to consumers in the target market. See Etsy GPSR requirements for creators for a practical way to structure listings.
Before publishing, the Marketplace Product Compliance Scanner can flag traceability, safety and compliance information to review in an Etsy listing. It identifies points to check; it is not certification or permission to place a product on the market.
Is CE marking compulsory for my Etsy products?
CE marking is compulsory only for product categories covered by EU legislation that requires it. You should neither put CE marking on an ordinary decorative item with no applicable sector-specific law nor assume that a handmade product falls outside CE rules when it belongs to a regulated category.
For example, toys, certain electrical equipment, radio equipment and equipment subject to electromagnetic-compatibility requirements can fall under specific legislation. Toy requirements are set out in Directive 2009/48/EC on the safety of toys. The European Commission also provides general guidance through Your Europe: CE marking.
Example: a decorative string light powered from the mains must not be treated as a simple decorative object. Its electrical design, components, instructions and applicable sectoral rules must be assessed before sale. By contrast, a non-electrical textile cover does not carry CE marking simply because it is sold to EU consumers.
The manufacturer remains responsible for conformity assessment, necessary testing, the technical documentation and, where required, the EU declaration of conformity. A CE authorised representative may be appointed by written mandate where the applicable legislation permits it, but does not replace your testing, technical documentation or EU declaration of conformity. For the records you need to prepare, read the CE technical file guide.
How do you prepare a first Etsy shipment to Europe step by step?
Prepare your first sale as a complete flow: product classification, safety information, the role of each operator, tax, customs, transport and Etsy listing content. This avoids discovering an obligation after a parcel is held at customs or a listing is blocked.
Practical procedure before you start selling
- Identify the exact product, its materials, intended use, foreseeable users and reasonably foreseeable risks. A candle, a child’s bracelet and a USB charger do not require the same assessment.
- Establish where the product is made, where it will be stored and the countries to which you will deliver. Country Compliance helps organise checks by origin, storage and destination country.
- Check the customs classification. The HS classification assistant generates candidate subheadings, which you must confirm in the Combined Nomenclature and the European Commission’s TARIC consultation. Incorrect classification can change duty, applicable measures and requested documents.
- Decide who imports, who submits the declaration and which Incoterm or delivery arrangement applies. Prepare a commercial invoice that matches the goods, value, origin and description. The EU import customs documents checklist explains the records to anticipate.
- Assess VAT: directly imported sale, possible IOSS use, stock import or sale from an EU warehouse. Do not confuse VAT charged to the customer with import VAT.
- Build the product-safety file: manufacturer identity, product references, materials, risk assessment, warnings, instructions and suitable evidence. If the product is CE-regulated, add the sector-specific documentation required.
- Write the Etsy listing with the required product information, then check that variants, photographs, warnings and contact details match the product actually dispatched.
Checklist before opening EU sales
- I have identified the manufacturer, any importer and the EU-established economic operator to be named or appointed.
- I have defined the dispatch country, storage country and destination countries for each flow.
- I have checked whether a customs declaration and EORI number are required for my role.
- I have confirmed the tariff classification and applicable measures in TARIC.
- I have selected and checked the VAT treatment for my scenario, including IOSS where relevant.
- I have gathered the necessary safety, traceability, warning and instruction information.
- I have checked whether sector-specific legislation and CE marking apply.
- I have reviewed every Etsy listing before publication, including variants and translations for the intended markets.
What documents and level of effort should you expect?
The effort varies significantly by product category and logistics model. A simple decorative item will often need less documentation than a toy, electrical product, cosmetic, or product intended for children; it still needs proportionate safety analysis and traceability.
For customs, you will usually need a precise commercial description, invoice, evidence relating to value and origin, and the data needed for tariff classification. For product safety, retain information that identifies the product and manufacturer, warnings, instructions and evidence showing that risks have been considered.
For a CE-regulated product, the file may include an assessment of applicable requirements, a risk analysis, test reports or other evidence where necessary, technical documentation and the EU declaration of conformity. The European Commission’s Blue Guide on the implementation of EU product rules explains placing-on-the-market principles and the roles of economic operators.
Do not look for one universal cost figure: the work depends on the number of product references, countries, stock volumes, technical complexity and documents already available. Review EU Seller Kit pricing and plans for the scope of tools and services, without assuming that a service replaces your responsibilities as manufacturer or seller.
What mistakes most often block Etsy sales to Europe?
Problems often arise because sellers confuse the online shop, transport arrangements and regulatory compliance. A listing can be visible on Etsy yet incomplete under the applicable rules, and a parcel can be dispatched without customs clearance being properly prepared.
Confusing EORI, VAT and product compliance
EORI identifies an operator in customs procedures. VAT concerns the taxation of transactions. GPSR and CE marking concern product safety and compliance. They meet in the same shipment, but none replaces the others.
Copying supplier information without checking it
A generic certificate, a test report for a different reference, or CE marking applied without assessment is not enough. If a product is made under your brand, obtain and review documents that match the precise reference you sell. For textiles, check in particular the fibre-composition and naming rules in Regulation (EU) No 1007/2011 on textile fibre names and labelling.
Overlooking obligations in the country of sale
Requirements can also concern packaging, waste electrical and electronic equipment, or batteries. Regulation (EU) 2025/40 on packaging and packaging waste changes the EU framework, while some extended producer responsibility obligations remain organised nationally. Check the rules in each country where you make packaged products available.
Finally, do not promise delivery “all taxes included” if your customs and VAT arrangements cannot support it. Inaccurate information can lead to customer refusal, unexpected charges or an import hold.

Frequently asked questions
Does Etsy handle all of my VAT obligations?
Etsy may collect or manage VAT amounts in scenarios defined by the platform and applicable rules. That does not automatically determine your import VAT treatment, obligations arising from EU stock, or reporting duties in every relevant country. Check the actual flow and, where needed, confirm it with the tax authority or a tax professional.
Can I sell handmade jewellery without an EORI number?
It depends on your role in customs formalities and your logistics flow. If you import stock into the EU yourself, an EORI is generally needed for the relevant customs operations. Direct sales to customers from a non-EU country must also be structured to establish who carries out the import and declaration.
Is a GPSR responsible person needed for every product?
The need for, and organisation of, an EU-established economic operator depends on your supply chain and the applicable regulatory framework. GPSR requires an EU-established responsible economic operator for covered products where no other qualifying operator is established in the EU. Also check whether your product falls under CE sector-specific legislation with its own importer or authorised-representative rules.
Do I need to show my supplier’s details on Etsy?
You must show the manufacturer’s contact details and, where required, those of the EU-established responsible economic operator, together with other applicable distance-selling information. If you market the product under your own brand, you are often the manufacturer to identify. The details of a simple supplier do not necessarily replace those of the legally relevant operator.
Is CE marking required for a handmade candle?
A handmade candle is not automatically subject to CE marking. You must nevertheless assess its safety under GPSR, consider risks arising from intended use and provide appropriate warnings or instructions. Its composition, fragrances, container and use may also trigger other requirements that need checking for the exact product.
Can I use the same EORI number for the EU and Great Britain?
The EU and Great Britain operate separate customs systems. An EU EORI does not necessarily replace a GB EORI for movements to or through Great Britain. Read the EU and GB EORI guide and GOV.UK guidance on getting an EORI number before dispatching goods.
