Cdiscount Seller Compliance: Product Obligations and Documents means checking before publication that every product is safe, traceable and supported by the applicable information and evidence. Cdiscount may request documents or remove an offer, but the marketplace does not take over the legal duties of the manufacturer, importer or distributor.

Key takeaways

  • A professional Cdiscount seller must ensure that the physical product, packaging, instructions, technical documents and online listing all match.
  • Regulation (EU) 2023/988, the General Product Safety Regulation (GPSR), has applied since 13 December 2024 and sets specific distance-selling information requirements for consumer products.
  • CE marking is required only for products covered by EU harmonisation legislation; it is neither a quality label nor EU approval.
  • Your actual role as manufacturer, importer or distributor determines the checks and documents you must hold.
  • An incomplete listing, or evidence that relates to another variant, can lead to a blocked listing, a request for documents or market-surveillance action.

Who is responsible for product compliance when selling on Cdiscount?

Any business making physical products available to consumers in the European Union is concerned. Whether you are established in France, another Member State or outside the EU does not by itself determine your duties: you need to identify your real role in the supply chain.

Cdiscount can review a listing, ask for a declaration or suspend a SKU. That does not transfer regulatory responsibility to the marketplace. During a check, authorities may seek to identify the manufacturer, importer, distributor and, where the applicable law requires one, the EU-established responsible economic operator.

What is the difference between a manufacturer, importer, distributor and responsible person?

The manufacturer makes the product, has it made, or markets it under its own name or trade mark. It is generally responsible for the conformity assessment, necessary testing, technical documentation, instructions and EU declaration of conformity where CE legislation requires one.

The importer is the EU-established operator that first places a product from a third country on the EU market. Within the limits of the applicable rules, it must check that the manufacturer has met its obligations and that the product carries the required information.

A distributor makes available a product already placed on the EU market without being its manufacturer or importer. It must act with due care and should not sell a product where non-compliance is apparent.

A GPSR responsible person is an economic operator established in the EU, required in certain arrangements for consumer products. This role is not automatically the same as importer, nor is it the same as a CE authorised representative. The economic-operator roles are set out in Decision No 768/2008/EC and explained in the European Commission’s 2022 Blue Guide.

Example: you buy generic night lights in China, apply your own brand, import the stock into France and sell it on Cdiscount. Although the factory physically makes the product, your business may be treated as the manufacturer because the product is marketed under your brand.

If you do not yet know which roles or rules apply to your trade flow, an EU market-entry compliance assessment can organise the checks to consider: EORI, VAT, GPSR, CE, packaging, WEEE, batteries and product-data readiness. It flags subjects to review; it does not replace legal analysis of your particular position.

What product rules must you check before publishing a Cdiscount listing?

Start with an accurate description of the actual product, then identify the general and sector-specific rules that apply. A supplier datasheet or marketing name is not enough: the function, materials, power supply, accessories, intended users and variants can all change the assessment.

Does the GPSR apply to your product?

Regulation (EU) 2023/988 on general product safety, known as the GPSR, has applied since 13 December 2024. It governs consumer-product safety where no sector-specific rule fully addresses the relevant risk, and it complements sector-specific legislation where appropriate.

A product must be safe under normal or reasonably foreseeable conditions of use. The assessment takes account of its design, materials, packaging, installation, instructions, warnings and the consumers for whom it is intended. Products used by children or other vulnerable groups require closer consideration of foreseeable risks.

In practice, the evidence expected for kitchen tongs will not be the same as for a toy, charger or smartwatch. You should nevertheless be able to explain why the warnings, instructions and documents chosen are appropriate for the SKU being sold. A structured risk assessment is particularly useful for retaining that reasoning by model and variant.

Is the product covered by CE legislation?

CE marking is mandatory only for categories covered by EU harmonisation legislation that requires it. The general principles are summarised by Your Europe: CE marking.

A toy is covered in particular by Directive 2009/48/EC on the safety of toys. A Bluetooth speaker, smartwatch or another product with a radio function may fall within Directive 2014/53/EU on radio equipment. Electrical equipment may also require assessment under low-voltage or electromagnetic-compatibility rules.

CE marking records the manufacturer’s declaration that it has followed the applicable conformity-assessment procedure and meets the relevant requirements. It does not mean that an EU authority has approved the product. Equally, adding a CE logo to a product outside CE legislation is an error.

A common mistake is accepting a generic “CE certificate” from a supplier. Check the exact model, variant, brand, cited standards, test evidence and applicable legislation. A different battery, charger, power rating or radio function may make earlier evidence inadequate. For a fuller review, see the CE marking guide for manufacturers and sellers.

EU Seller Kit — Before ordering a new SKU or changing manufacturer, use Supplier Check to centralise identity, payment and delivery information for review, then compare it with the technical documents you need.

What information must appear on your Cdiscount product listing?

For products within scope, your Cdiscount listing must give the consumer the necessary identification, safety and economic-operator information before purchase. The information must match the product, its packaging and the documents you retain.

The GPSR sets requirements for distance-selling offers. Article 19 requires the offer to make available product identification, the manufacturer’s contact details and, where the manufacturer is not established in the EU, the contact details of the EU-established responsible person, together with relevant warnings and safety information. See the detailed guide to GPSR Article 19 listing information.

Information to prepare for each SKU

Depending on the product and applicable rules, prepare:

  • clear product identification: model, type, batch, serial number or another traceability identifier;
  • the manufacturer’s name or trade mark, postal address and electronic contact method;
  • the contact details of the EU-established responsible operator where required;
  • warnings, age restrictions, instructions and directions needed for safe use;
  • applicable sector-specific information, such as toy warnings, textile fibre composition or information for electrical equipment;
  • CE-marking information where the product category is subject to it.

Safety information must be understandable in the target market. For sales to French consumers, English-only instructions may be insufficient, depending on the category and applicable rules. Check sector-specific language requirements and, if uncertain, consult the competent authority or a qualified adviser.

Imagine a children’s water bottle. A sales description praising its design is not enough. The listing should identify the model, present the required contact details and show relevant warnings. If you sell it under your own brand, your details may be those of the manufacturer.

Before publication, the Marketplace Product Compliance Scanner can analyse your listing and flag traceability, safety and compliance information to verify. It does not approve the technical file and does not replace Cdiscount’s own operational rules.

How do you prepare Cdiscount Seller Compliance: Product Obligations and Documents step by step?

Prepare the file before stock is shipped and before the first listing goes live. This sequence avoids rushed corrections when the marketplace asks for evidence or a market-surveillance authority requests documents.

A practical process for each product and variant

  1. Describe the actual product. Record its function, materials, power rating, accessories, power supply, connected features, intended users and variants. A new colour may have no effect; a different battery may well do.

  2. Identify the applicable legislation. Review the GPSR first, then sector-specific rules. Clothing may be subject to Regulation (EU) No 1007/2011 on textile fibre names and labelling. Electrical products may be covered by several CE instruments and separate environmental obligations.

  3. Assign the roles. Identify the manufacturer, importer, distributor and, where relevant, the EU-established operator. For a consumer product made outside the EU, an EU GPSR responsible person may be needed. This service becomes active only after product review, entity assignment, a signed mandate and active payment; a SaaS subscription does not automatically appoint a responsible person.

  4. Gather the evidence. Keep specifications, risk assessments, relevant test reports, label photographs, instructions and, for CE products, the EU declaration of conformity. The CE technical file guide explains the documents to assemble before placing a product on the market.

  5. Align every format. Compare the model, brand, contact details, warnings and references across the product, packaging, instructions, declaration and listing. A declaration for “X100” does not automatically cover “X100 Pro”.

  6. Archive records and prepare to cooperate. File documents by SKU, batch and version. Regulation (EU) 2019/1020 on market surveillance and compliance of products provides the framework for compliance checks. If an authority or marketplace asks for material, you should be able to retrieve the relevant evidence promptly.

Cdiscount pre-publication checklist

  • I have identified the manufacturer, importer, distributor and my actual role for every SKU.
  • I have checked whether the GPSR, CE legislation and relevant sector-specific rules apply.
  • The product and packaging carry the required identifiers and contact details.
  • Necessary warnings and instructions are available in a language suitable for the French market.
  • Reports, declarations and other evidence cover the model, variant and brand being sold.
  • The Cdiscount listing displays the necessary safety, traceability and operator information.
  • I have archived labels, instructions, declarations and evidence by SKU.
  • I have reviewed obligations for packaging, electrical equipment, cells or batteries where relevant.

What documents should you be able to provide to Cdiscount or an authority?

The documents depend on the category, but your file should demonstrate safety, traceability and, where applicable, conformity assessment. A supplier invoice proves a transaction; it does not by itself prove that the product complies.

For a consumer product, retain at least an identification sheet with photographs, model and variants; operator contact details; labels; packaging; instructions; warnings; traceability information; specifications; and available test reports. A product-specific risk assessment helps connect those records to the risks identified.

For a CE-marked product, add the technical documentation, reports or other conformity-assessment evidence, and the EU declaration of conformity signed by the manufacturer. The declaration should identify the product and applicable legislation. The EU declaration of conformity guide explains what the manufacturer should prepare before signing.

A CE authorised representative may be required or useful depending on the applicable legislation and the arrangements of a non-EU manufacturer. It does not replace the manufacturer’s conformity assessment, testing, technical documentation or EU declaration of conformity. The CE authorised representative service is based on a written mandate and becomes active only after acceptance, entity assignment, a signed mandate and active payment.

Example: a US manufacturer sells radio equipment under its own brand on Cdiscount. It must first determine the applicable CE legislation, compile its documentation and sign its EU declaration of conformity. Appointing an authorised representative, where appropriate, does not turn an incomplete file into a compliant one.

EU Seller Kit — If you are a non-EU manufacturer of CE-marked products, the CE authorised representative service may be relevant where a written mandate is needed under applicable CE legislation; it does not carry out your testing, assessment or declaration.

Do you need EORI, customs and VAT arrangements to sell on Cdiscount?

Yes, if you import stock yourself from outside the EU or carry out customs operations. Product compliance and customs clearance are separate, but inconsistencies between the product, tariff code, value, origin or declared importer can delay release of the goods.

An EORI number identifies operators in dealings with EU customs authorities. The European Commission’s EORI guidance explains its role. The number is issued by the competent customs authority; EORI file preparation is a one-off preparation service unless included in a plan quota, while registration remains the authority’s decision.

Example: stock from Shenzhen to a French warehouse

If you ship goods from Shenzhen to a warehouse in France before selling them on Cdiscount, align the customs code, value, origin, commercial invoice, declared importer and VAT treatment. Regulation (EU) No 952/2013, the Union Customs Code, provides the framework for EU customs formalities.

Start by finding candidate subheadings with the HS classification assistant, then confirm the classification in the European Commission’s TARIC consultation. You can then structure known import costs with the customs cost simulator. These tools help prepare data; they do not replace a binding tariff decision, customs declaration or authority position.

For import VAT and cross-border sales, the EU VAT calculator can compare common scenarios using your transaction data. If you hold stock in several Member States or sell beyond France, verify your VAT arrangement with the tax authority or a qualified adviser.

Which mistakes most often lead to a blocked listing or compliance check?

Problems usually arise from a mismatch between the actual product, supplier documents and published listing. Changing only the listing title or images does not resolve a substantive inconsistency.

Treating an invoice as proof of compliance

An invoice shows that a transaction took place. It does not replace a risk assessment, instructions, test report or EU declaration of conformity where those are required. Always check that documents identify the model and variant actually being sold.

Using CE marking as a sales claim

CE marking does not apply to every product and should not be added merely to reassure buyers. Where it is mandatory, the manufacturer must have followed the applicable procedure. A logo without coherent supporting documentation can trigger a request for evidence or corrective action.

Leaving out contact details or warnings from the listing

For products covered by the GPSR, an incomplete distance-selling offer can lead to a correction, listing removal or difficulty during an inspection. Do not copy a competitor’s listing data: verify the information for your own product and economic operators.

Assuming a subscription automatically appoints a representative

A SaaS subscription does not automatically appoint a GPSR responsible person or CE authorised representative. These roles require acceptance, entity assignment, a signed mandate and active payment under the relevant service. Compare the roles through the EU representation services overview.

Overlooking environmental obligations

Product safety is not the whole picture. Packaging, electrical equipment, cells and batteries may be subject to separate duties. Regulation (EU) 2025/40 on packaging and packaging waste establishes an EU framework, while practical registrations and labelling steps can depend on the country where packaging is placed on the market. In France, also review the rules on Triman and Info-tri labelling.

If a SKU is already blocked, identify the exact reason, inspect the product and documents, then align the listing, label and evidence before requesting another review. Republishing the same offer under another title does not correct non-compliance.

Tools and services to take action

  • EU Market Entry Compliance Assessment — use it before a first shipment or new category to organise the EORI, VAT, GPSR, CE, packaging, WEEE, battery and product-data checks to review.
  • Marketplace Product Compliance Scanner — analyse a Cdiscount listing before publication to identify traceability, safety and compliance information that needs checking.
  • GPSR Responsible Person (EU) — consider this service when a non-EU manufacturer or seller needs an EU-established responsible operator; it becomes active only after review, assignment, a signed mandate and active payment.
  • CE Authorised Representative — use it when a non-EU manufacturer needs a written authorised-representative mandate under applicable CE legislation, without delegating its conformity assessment or technical file.
  • EU Seller Kit pricing and plans — review SaaS plans and add-on services for your operating model without assuming that any representation service is activated automatically.

Frequently asked questions

Does Cdiscount check documents before every product goes on sale?

Cdiscount may request documents or information before or after publication, particularly for certain categories or where an offer appears incomplete. Prepare your evidence before listing the product. Marketplace procedures can change, so also check the rules that apply to your seller account.

Can I sell using a CE certificate supplied by my Chinese supplier?

A supplier document can contribute to your file, but it is not enough by itself. Check that it covers the exact model, variant, brand and applicable legislation, then obtain the EU declaration of conformity and relevant technical evidence where CE marking is required. If you sell under your own brand, you may take on manufacturer responsibilities.

Is a GPSR responsible person needed for every seller?

No. The requirement depends on the product, the operators already present in the supply chain and where the manufacturer is established. For consumer products within the GPSR framework, a non-EU manufacturer must have an EU-established responsible operator under the applicable arrangements, so assess your supply chain before publishing.

Can I use the same documents for several variants?

Yes, but only where the documents genuinely cover every variant. A cosmetic change may sometimes be covered, while a different material, power rating, battery, charger or connected function can change the risks and applicable rules. Record your assessment and check the references stated in reports and declarations.

Is CE marking enough to sell electrical equipment?

No. CE marking does not remove traceability, economic-operator contact, warning, instruction or possible environmental obligations. The technical documentation and EU declaration of conformity must also match the product actually sold.

Do I need an EORI number to sell on Cdiscount?

An EORI number is generally needed when you carry out customs operations, for example when importing stock yourself from outside the EU. It is not evidence of product compliance and does not replace VAT obligations or safety documents. Where flows involve several countries or complex arrangements, check your position with the customs authority or a qualified adviser.
