Amazon Pan-EU Compliance: EORI, VAT and GPSR Requirements must be addressed before Amazon stores your goods across EU Member States. You need to organise customs formalities, assess VAT registrations and reporting, and verify product safety and listing information. Amazon does not automatically become your importer, manufacturer or responsible economic operator in the European Union.
Key takeaways
- Storing goods through Amazon Pan-EU in a Member State can create VAT obligations in that country, even if you have no office or employees there.
- An EORI number is used for import and export customs formalities; it does not replace a VAT number or a VAT registration.
- Since 13 December 2024, Regulation (EU) 2023/988 requires safety, traceability and information measures for relevant consumer products sold in the EU.
- Products subject to CE marking must meet the applicable sector-specific legislation before being placed on the market; a CE mark without conformity assessment is not enough.
- Before sending your first shipment to an FBA warehouse, document every actor's role, the import country, storage countries, stock movements and the information shown on the Amazon listing.
Who is affected by Amazon Pan-EU compliance requirements?
You are affected when your units are imported into the EU, placed with Amazon FBA and may be stored in more than one country. This includes EU-established sellers as well as non-EU manufacturers and sellers, including businesses manufacturing in China, the United States, Great Britain or Türkiye.
Pan-EU works through distributed storage. You send stock into an Amazon network and Amazon may then move units between approved fulfilment centres. The country where goods are physically stored matters. It is not only your company’s country of establishment or the country from which the customer places an order.
Separate the roles before shipment
Several roles may exist in the same supply chain:
- The manufacturer designs or has the product made under its name or trade mark and, depending on the product, carries conformity responsibilities.
- The importer places a product from a third country on the EU market. Its identity should be consistent across customs and commercial documents.
- The Amazon seller publishes the offer and must provide accurate information to the marketplace and consumers.
- An EU-established economic operator may be required under particular product rules.
- Amazon provides a marketplace and, under FBA, logistics services. This does not automatically transfer your regulatory obligations to Amazon.
Example: a US company sells kitchen accessories made in Shenzhen. It imports a first consignment into Germany under an arrangement to be agreed with its customs representative, then activates Pan-EU. Units later move to France, Italy and Spain. The business must assess the import, VAT in storage countries, product-safety information and product conformity separately.
If you do not yet know which rules apply to your products, storage countries and flows, start with an EU market-entry compliance assessment. It helps you structure customs, VAT, GPSR, CE, packaging and other checks before shipment.
Do you need an EORI number to send stock to Amazon FBA?
An EORI number is generally needed by the operator carrying out EU customs formalities, particularly when importing stock from a third country. It identifies the operator to customs authorities; it is neither permission to sell nor a VAT number.
The customs framework follows the Union Customs Code, Regulation (EU) No 952/2013, while operational EORI rules are set out in Implementing Regulation (EU) 2015/2447. The European Commission confirms that EORI identifies operators in their dealings with EU customs authorities in its EORI guidance.
Choose the relevant country and prepare the application
The country in which you apply depends on factors including your establishment, your first customs operation and your status as an operator. A non-EU business should carefully establish where it must register before asking a customs representative to submit a declaration.
A common mistake is shipping stock before identifying the importer, declarant and EORI number to be used. That can lead to an inconsistent declaration, a customs hold or time-consuming document corrections.
Use EORI file preparation to prepare an application. This is a one-off service unless included in a SaaS plan quota; the EORI number itself is issued by the competent customs authority. For more detail, read the guide on which country should issue your EORI number.
Do not confuse EORI, tariff classification and customs value
EORI identifies the operator. Tariff classification identifies the product within the customs nomenclature. Customs value and origin affect duty and other measures. These details must align across the commercial invoice, customs declaration and logistics documents.
Before estimating an import, use the HS classification assistant to identify candidate HS subheadings, then confirm the classification through the European Commission’s TARIC consultation tool. To structure known shipment costs, use the customs cost simulator, while checking that the tariff rate is valid for your goods.

What VAT obligations can storage in several countries create?
Holding your own goods in several Member States must be assessed country by country for VAT. In practice, the initial import, stock transfers between countries and consumer sales can fall under different VAT mechanisms. OSS does not automatically remove obligations arising from local stock.
EU VAT is based on Council Directive 2006/112/EC on the common system of VAT. Your Europe’s VAT guidance for businesses is a useful starting point, but implementation also depends on national rules and the way your goods move.
Why Pan-EU makes VAT analysis more involved
Imagine your stock enters the EU through Germany and Amazon later distributes it to France and Spain. You need to distinguish:
- the import and import VAT in the country of entry;
- transfers of your own goods between Member States;
- domestic sales from a storage country;
- cross-border sales to consumers in other Member States;
- possible registration and reporting obligations in each relevant country.
The One Stop Shop, or OSS, can simplify reporting for certain intra-EU B2C distance sales. It does not, by itself, resolve the VAT treatment of stock movements or obligations created by local storage. The European Commission’s OSS and IOSS portal explains the schemes concerned.
IOSS is often mentioned in ecommerce, but it applies to certain distance sales of imported goods in low-value consignments. It is not the usual regime for bulk replenishment of stock into an Amazon FBA warehouse. Do not treat it as a shortcut for pallets or cartons sent for storage.
A practical method for mapping your VAT flows
Record the entry country, activated storage countries, customer destination countries, importer identity and Incoterms agreed with the supplier. Keep Amazon stock-movement reports. You will need them to reconstruct movements and prepare returns with your VAT adviser or filing provider.
The EU VAT calculator can compare common domestic, intra-EU and import VAT scenarios using your transaction data. It does not replace registration, a VAT return or professional advice where your arrangement involves stock in several countries.
What does the GPSR require for products sold through Amazon Pan-EU?
Regulation (EU) 2023/988 on general product safety, known as the GPSR, has applied since 13 December 2024 to relevant consumer products. It requires products made available on the market to be safe and strengthens traceability, information and cooperation duties towards authorities and online marketplaces.
The applicable text is Regulation (EU) 2023/988. Where a product is covered by sector-specific EU harmonisation legislation, that legislation remains decisive for the risks and requirements it covers. GPSR may still matter for aspects not covered by that sector-specific legislation.
Responsible person, importer and product information
For consumer products from a non-EU manufacturer, you must identify the EU-established economic operator that will carry out the functions required under the GPSR. Depending on the supply chain, this may be an EU-established manufacturer, importer, authorised representative or responsible person.
A SaaS subscription does not itself appoint a responsible person. A GPSR responsible-person service becomes active only after product review, entity assignment, a signed mandate and active payment. If your situation requires it, review the EU GPSR Responsible Person service and its activation conditions before placing products on the market.
The product, its packaging or an accompanying document must provide appropriate identification and traceability: product type, batch or serial number where relevant, manufacturer contact details and, where required, the contact details of the EU responsible person. Warnings and safety information must be understandable to consumers in the intended market.
Amazon listings must show the required information too
Compliance is not limited to a label attached to the product. For distance sales, the GPSR requires specified information to be accessible in the online offer, including product identification, manufacturer details and, where the manufacturer is not established in the EU, the details of the responsible EU operator, together with relevant warnings and safety information. Review the explanation of GPSR Article 19 distance-sales information requirements before publishing or changing listings.
Example: a non-EU seller offers a decorative lamp. A listing containing only a title, photographs and an internal product code may not allow a consumer or authority to identify the product, manufacturer, EU-established operator and applicable warnings. Amazon may request further evidence, and a market-surveillance authority may request the file and conformity evidence.
Before publication, review visible listing information with the marketplace product compliance scanner. It flags traceability, safety and compliance details to verify; it does not replace a legal or technical assessment of the product.
Is CE marking required for every Pan-EU product?
No. CE marking is required only for product categories covered by EU legislation that specifically requires it. You should neither add it as a precaution to an out-of-scope product nor assume that a product made outside the EU is compliant simply because it already bears a CE logo.
The European Commission’s Your Europe guidance on CE marking explains that the manufacturer must identify applicable requirements, complete the required conformity assessment, prepare technical documentation and sign an EU declaration of conformity where the sectoral framework requires it.
Products commonly affected in Amazon catalogues
Toys are covered, among other rules, by Directive 2009/48/EC on the safety of toys. Radio equipment, including certain connected devices and Bluetooth or Wi-Fi products, may fall within Directive 2014/53/EU on radio equipment. Other electrical equipment may be subject to low-voltage or electromagnetic-compatibility rules depending on its characteristics.
Example: a USB charger sold with a travel accessory should not be treated as a simple accessory. Its voltage, function, design and applicable directives determine the testing, technical file and information required. Request relevant test reports, the EU declaration of conformity, risk assessment and exact model references from the manufacturer before ordering.
A CE authorised representative may perform certain tasks where the applicable legislation permits it and a written mandate is in place. It never replaces the manufacturer’s conformity assessment, testing, technical documentation or EU declaration of conformity. Read the guide to the role and limits of a CE authorised representative before deciding whether one is needed.
GPSR and CE are complementary checks
A CE-marked product must meet its sector-specific rules. A product outside CE marking is not therefore exempt from safety obligations: GPSR may apply. In both cases, traceability, suitable warnings and consistent Amazon listing information remain essential.
If you are a non-EU manufacturer and your product needs an authorised representative under the applicable CE legislation, the CE Authorised Representative service can begin only once a written mandate and the relevant activation conditions are in place. First confirm that your product legislation permits and requires that appointment.
How do you prepare for Amazon Pan-EU step by step?
Prepare your rollout in the order your actual flows occur: product, supplier, classification, import, VAT, storage, sales information and ongoing records. This sequence helps prevent discovering, after goods arrive, that a document, registration or listing detail is missing.
Checklist before your first FBA shipment
- Define the manufacturer, importer, Amazon seller, customs declarant and EU-established economic operator where required.
- List SKUs, variants, components, manufacturing countries and intended Amazon storage countries.
- Check the proposed tariff code in TARIC, origin, customs value and commercial documents.
- Prepare or verify the relevant operator’s EORI number and check it through the official EORI validation tool where the data is publicly available.
- Map imports, stock movements and sales to identify VAT matters to address in each country.
- Gather conformity documents: risk assessment, relevant test reports, technical documentation, EU declaration of conformity where needed, labels and instructions.
- Check the contact details, product identifiers, warnings and safety information displayed on every Amazon listing.
- Review additional national obligations, including packaging, WEEE, batteries, textiles and regulated product categories according to the goods and countries involved.
- Archive Amazon stock-movement reports, invoices, customs declarations and versions of product listings.
Packaging and extended producer responsibility obligations do not disappear because Amazon stores or delivers the goods. Regulation (EU) 2025/40 on packaging and packaging waste establishes an EU framework, while national requirements may continue to apply according to the country and timetable. Check local rules before activating a new storage country.
Use Country Compliance to organise checks by origin, storage and destination country. For commercial invoices and import paperwork, TradeFlow AI can help you prepare or review documents, subject to its stated limitations and available sources.
What mistakes most often delay or block a Pan-EU launch?
Problems rarely come from a single rule. They arise when customs, tax, technical and marketplace data have been prepared separately and do not match. A poorly described SKU can affect tariff classification, the customs declaration, labelling and the Amazon listing at the same time.
Assuming Amazon takes care of compliance
Amazon may request documents, suspend an offer or apply its own catalogue rules. However, the platform does not automatically become the manufacturer, importer or responsible person for your products. You should be able to explain who performs each role and provide the evidence requested.
Treating an EORI as a VAT number
EORI is for customs identification. A VAT number is for tax obligations. Both may appear in the same operational file, but they serve different purposes. Read EORI vs VAT number vs IOSS: which do you need to sell in Europe? to avoid building your flow on this basic misunderstanding.
Copying a CE declaration or test report without checking the model
A document may look complete while covering another model, version, factory or directive. Check the manufacturer identity, exact reference, cited standards, date, signatory and consistency with the product actually shipped. An EU declaration of conformity is useful only if it relates to the product placed on the market.
Showing a responsible person that has not been activated, or inaccurate details
The details of an EU-established operator must reflect a real relationship and the products covered. Do not copy an address from supplier packaging without a mandate or verification. It can create misleading information, complicate an authority request and lead to a listing being blocked.
Forgetting that requirements vary by product and country
Textiles, toys, batteries, cosmetics and connected devices do not follow the same rules. Safety, labelling, waste take-back and language requirements can differ. Before adding a new SKU, use Supplier Check to centralise manufacturer information and identify inconsistencies to review before ordering.

Frequently asked questions
Does Amazon become the importer when I use Pan-EU?
No, not automatically. The importer must be identified in your commercial and customs arrangement, with consistent documents including the invoice, Incoterm, customs declaration and product responsibilities. Confirm this with your customs declarant before stock is shipped.
Is one EORI number enough for all EU storage countries?
EORI is a customs identifier for the operator in the European Union, but the answer depends on your establishment and operations. Holding stock in several countries does not automatically mean you need a separate EORI in each one. VAT and reporting obligations must nevertheless be assessed separately for each storage country and flow.
Can I use OSS if Amazon moves my stock between countries?
OSS may be relevant to certain B2C distance sales, but it does not automatically settle the VAT consequences of moving your own stock or holding local stock. Retain Amazon movement reports and have your arrangement checked by a VAT professional familiar with the countries concerned.
Does GPSR apply to products carrying CE marking?
GPSR has applied since 13 December 2024 to relevant consumer products, while CE-marked products are primarily governed by their sector-specific legislation for the risks it covers. Both frameworks may therefore need to be assessed together. Traceability and distance-sales information are particularly relevant on Amazon.
Does a GPSR responsible person replace a CE authorised representative?
No. The GPSR responsible person and the CE authorised representative are distinct roles, governed by different legislation and mandates. Depending on the product and applicable rules, you may need one, the other, or neither external service if an operator in your supply chain already validly fulfils the required role.
Must I put CE marking on every product sold on Amazon?
No. CE marking is reserved for products covered by EU legislation that requires it. For other consumer products, you must still assess safety, traceability, labelling and information requirements under GPSR or other sector-specific rules.
What should I do if Amazon blocks a listing for compliance reasons?
First identify the exact reason and the affected SKU, then compare the requested documents with the product actually sold and the visible listing information. Correct documentary, technical or display inconsistencies before resubmitting the file. The guide to an Amazon listing blocked for compliance explains this process in more detail.
