What does GPSR Article 16 require?

Article 16 provides that a product covered by the GPSR may not be placed on the Union market unless a responsible economic operator is established in the EU. That operator performs the applicable tasks, carries out specified documented checks, and must be identifiable on the product, packaging, parcel, or accompanying document.

What Article 16 covers

• A responsible economic operator established in the Union.
• Tasks under Article 4(3) of Regulation (EU) 2019/1020.
• Checks concerning technical documentation, identification, and safety information.
• The responsible operator’s name, postal address, and electronic address.

Example for a non-EU manufacturer

A US manufacturer selling a covered consumer product directly to EU customers must identify which EU-established economic operator fulfils Article 16. A contractual appointment only applies to the products and tasks included in the accepted mandate.
